A federal appeals court on Monday reversed the dismissal of a lawsuit alleging a North Carolina zoo’s treatment of captive grizzly bears violated the Endangered Species Act.
In a 2-1 decision, the 4th U.S. Circuit Court of Appeals said the trial judge erred in finding the Cherokee Bear Zoo’s private owners, Barry and Collette Coggins, did not violate the Endangered Species Act because their zoo met the standards for captive animals in another federal law, the Animal Welfare Act.
